Terms & Conditions

These Terms & Conditions govern your use of the services provided by Quillkeeper, a writing studio operating at Lot 18, Jalan Sultan Idris Shah, 30000 Ipoh, Perak, Malaysia. By booking or attending any Quillkeeper service, you agree to these terms in full. Please read them carefully before making an enquiry or booking.
1. Definitions
In these Terms & Conditions, the following words carry the meanings given below.
- "Quillkeeper" / "we" / "us" / "our" — the writing studio trading as Quillkeeper, located at Lot 18, Jalan Sultan Idris Shah, 30000 Ipoh, Perak, Malaysia.
- "Service" — any of the structured writing programmes offered by Quillkeeper, including the Personal Records Writing Workshop, the Family History Writing Project, and the Yearlong Personal Writing Subscription.
- "Participant" / "you" / "your" — any individual who books, attends, or otherwise engages with a Quillkeeper service.
- "Session" — a scheduled meeting, in-studio or by call, between a Participant and a Quillkeeper facilitator as part of a booked service.
- "Written Output" — any document, template, booklet, or written material produced by a Participant during or as a result of a Quillkeeper service.
- "Agreement" — these Terms & Conditions together with any booking confirmation issued by Quillkeeper.
2. Acceptance of Terms
By submitting an enquiry, making a booking, or attending a Quillkeeper session, you confirm that:
- You have read and understood these Terms & Conditions;
- You are at least 18 years of age, or are acting with the written consent of a parent or legal guardian;
- You have the legal capacity to enter into this Agreement under the laws of Malaysia; and
- You agree to be bound by these terms for the duration of your engagement with Quillkeeper.
If you do not agree with any part of these terms, please do not proceed with a booking.
3. Service Description
Quillkeeper offers structured educational writing programmes. Each service is described in detail on our website. In summary:
- Personal Records Writing Workshop (RM 470) — a three-hour group workshop (up to six participants) focused on writing a personal records document, using publicly available templates. Includes a printed template and a reading list.
- Family History Writing Project (RM 1,520) — three one-to-one sessions in which the participant writes a short family history document, supported by a facilitator who provides structure and prompts. Includes a printed booklet and a follow-up note at three months.
- Yearlong Personal Writing Subscription (RM 2,920 per year) — a twelve-month subscription for one participant, including a monthly thirty-minute facilitator call, quarterly writing prompts, and an annual printed booklet.
All services are delivered from our studio in Ipoh, Perak, or by telephone or video call where stated. Services are available to residents of Malaysia. Enquiries from outside Malaysia are considered on a case-by-case basis.
Scope limitation: Quillkeeper's services are educational in nature. They do not include legal advice, financial advice, or psychological counselling. Facilitators are writing practitioners, not licensed legal, financial, or mental health professionals.
4. Booking & Payment
4.1 Booking Process
Bookings are accepted by enquiry via our website contact form, by email to [email protected], or by telephone. A booking is confirmed only when Quillkeeper issues a written confirmation and payment is received in full (or as otherwise agreed in writing).
4.2 Pricing
All prices are quoted in Malaysian Ringgit (RM) and are inclusive of any applicable taxes. Prices quoted at the time of booking confirmation are the prices that apply to that booking. Quillkeeper reserves the right to adjust pricing for future bookings with reasonable notice.
4.3 Payment Methods
Quillkeeper accepts payment by bank transfer to accounts provided in the booking confirmation. Payment must be received in full before the first session of any service, unless a written payment schedule has been agreed.
4.4 Cancellation and Refunds
The following cancellation terms apply:
- More than 7 days before the first session: a full refund will be issued, less any bank transfer fees incurred by Quillkeeper.
- Between 3 and 7 days before the first session: a 50% refund of the total service fee will be issued.
- Less than 3 days before the first session: no refund is available, but Quillkeeper will use reasonable efforts to reschedule the booking to a suitable date within 60 days.
- Yearlong subscription cancellations: if a participant wishes to end a Yearlong Subscription before the twelve months are complete, a pro-rata refund will be calculated for any full remaining calendar months, less a RM 150 administrative fee.
Refund requests must be made in writing to [email protected]. Refunds are processed within 14 working days of written confirmation.
4.5 Rescheduling
Participants may reschedule a session with at least 48 hours' written notice at no charge. Rescheduling requests made with less than 48 hours' notice will be accommodated where possible but are not guaranteed.
5. Service Delivery
5.1 Delivery Standards
Quillkeeper will deliver each service using a facilitator with appropriate experience and training in the studio's methods. We will provide the printed outputs described in the service specification at no additional charge to the quoted price.
5.2 Session Scheduling
Sessions are scheduled by mutual agreement between the participant and Quillkeeper. The studio operates Tuesday and Thursday 9am–5pm and Saturday 9am–1pm (Ipoh local time). Sessions outside these hours may be arranged at Quillkeeper's discretion.
5.3 Changes to Service
Quillkeeper reserves the right to make reasonable changes to a service's format, timing, or facilitator with reasonable written notice. If a change materially affects the nature of the service, the participant will be offered the option to continue on the revised terms or to receive a pro-rata refund.
5.4 Studio Conduct
Quillkeeper maintains a respectful working environment. Sessions are focused on writing; they are not forums for legal, financial, or medical consultation. Facilitators will redirect questions outside the educational scope of the service.
6. Participant Responsibilities
As a participant in a Quillkeeper service, you agree to:
- Attend scheduled sessions on time, or give advance notice if you are unable to attend;
- Engage with the service in a way that is respectful of the facilitator and, in group settings, of other participants;
- Not record any session (audio, video, or otherwise) without the prior written consent of Quillkeeper and all other participants present;
- Not use Quillkeeper's templates, prompts, or materials for commercial distribution or resale;
- Take responsibility for the accuracy of the personal and family information you choose to include in your Written Output; and
- Understand that writing sessions are not a substitute for professional legal, financial, or personal advice.
7. Intellectual Property
7.1 Participant's Written Output
All writing produced by a participant during a Quillkeeper service belongs entirely to the participant. Quillkeeper makes no claim over any personal records document, family history document, or other Written Output produced by a participant.
7.2 Studio Materials
Templates, writing prompts, structural frameworks, and any other materials provided by Quillkeeper to participants are for personal use only. They may not be reproduced, distributed, adapted, or used commercially without prior written permission from Quillkeeper.
7.3 Quillkeeper Name and Brand
The name "Quillkeeper", the studio's logo, and all associated branding remain the intellectual property of the studio. You may not use these in any public context without written permission.
8. Privacy & Handling of Personal Records
Quillkeeper takes the privacy of participants seriously. In particular:
- All personal information and Written Outputs shared during sessions are treated as confidential and will not be disclosed to third parties without your consent, except as required by Malaysian law.
- Quillkeeper does not retain copies of participants' Written Outputs. Printed materials are prepared for the participant and returned to them at the end of the service.
- Session notes kept by facilitators for internal continuity purposes are kept securely and are not shared.
- Our full Privacy Policy is available at privacy-policy.html and forms part of this Agreement by reference.
9. Disclaimers
Quillkeeper's services are provided on an "as available" basis for educational purposes. In particular:
- We do not represent that completing any Quillkeeper service will result in any specific personal, family, legal, or financial outcome.
- We do not represent that a Written Output produced during a Quillkeeper service will satisfy any legal, institutional, or governmental requirement.
- The templates and prompts used in our services are general in nature. Participants should seek independent professional advice for matters requiring legal, financial, or medical expertise.
- To the extent permitted by Malaysian law, Quillkeeper excludes all representations, warranties, and conditions not expressly set out in these Terms.
10. Limitation of Liability
To the fullest extent permitted under Malaysian law (including the Consumer Protection Act 1999 where applicable):
- Quillkeeper's total liability to you arising from or in connection with any service shall not exceed the total amount paid by you for that specific service.
- Quillkeeper shall not be liable for any indirect, consequential, or incidental loss arising from the use of our services, including loss of data, loss of documents, or any reliance placed on Written Outputs.
- Nothing in these Terms excludes liability for death or personal injury caused by Quillkeeper's negligence, or for fraudulent misrepresentation.
- Quillkeeper shall not be held liable for delays or non-performance caused by circumstances outside our reasonable control, including but not limited to natural events, illness, or disruption to utilities.
11. Indemnification
You agree to indemnify and hold harmless Quillkeeper, its facilitators, and its agents from and against any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of any Written Output or studio materials, or your failure to comply with applicable law in connection with your use of Quillkeeper's services.
12. Termination
12.1 By the Participant
A participant may withdraw from a service at any time by written notice to Quillkeeper. Refund entitlements are as set out in Section 4.4.
12.2 By Quillkeeper
Quillkeeper reserves the right to terminate a participant's access to a service with immediate effect, and without refund, if the participant engages in conduct that is abusive, disruptive, or harmful to facilitators or other participants, or if the participant materially breaches these Terms.
12.3 Survival
Sections 7, 9, 10, 11, and 13 of these Terms shall survive termination of any service engagement.
13. Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from these Terms or any Quillkeeper service shall be subject to the jurisdiction of the courts of Malaysia, with venue in Perak where applicable.
13.2 Informal Resolution
Before commencing any formal proceedings, you agree to first contact Quillkeeper in writing at [email protected] and allow us 21 days to attempt to resolve the matter informally.
13.3 Consumer Rights
Nothing in these Terms affects your rights under the Consumer Protection Act 1999 (Malaysia) or any other applicable consumer protection legislation.
14. General Provisions
- Entire Agreement. These Terms, together with any written booking confirmation from Quillkeeper, constitute the entire agreement between you and Quillkeeper in relation to the services. They supersede all prior communications, representations, and understandings.
- Severability. If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect.
- Waiver. A failure by Quillkeeper to enforce any provision of these Terms shall not constitute a waiver of that provision or of any other right.
- Assignment. Quillkeeper may assign its rights and obligations under these Terms to a successor business. Participants may not assign their booking or any rights under these Terms without prior written consent.
- Notices. Written notices under these Terms should be sent to [email protected] or by post to Lot 18, Jalan Sultan Idris Shah, 30000 Ipoh, Perak, Malaysia.
15. Changes to These Terms
Quillkeeper may update these Terms from time to time. When we do so:
- The revised Terms will be posted on our website with an updated "Last Updated" date;
- For existing bookings and active subscriptions, we will provide at least 14 days' written notice of any material changes; and
- Your continued use of Quillkeeper's services after the effective date of any change constitutes your acceptance of the revised Terms.
If you do not agree with a change, you may cancel your booking in accordance with Section 4.4 before the revised Terms take effect.
